TERMS AND CONDITIONS

1. Introduction

1.1 These Terms & Conditions (“Terms”) govern your use of the website www.wonderland-foundation.co.za and any online services, forms, donations, memberships or event reservations offered through it (together, the “Site”). Wonderland Foundation

1.2 The Site is operated by Wonderland Foundation (NPC), a non-profit company based in Hout Bay, Cape Town, South Africa (“Wonderland Foundation”, “we”, “us”, “our”). Wonderland Foundation

1.3 By accessing or using the Site, you confirm that you have read, understood and agree to these Terms. If you do not agree, please do not use the Site.

2. Purpose of Wonderland Foundation

3.1 The Site and our in-person gatherings are intended for individuals 21 years and older, unless expressly stated otherwise for a specific initiative.

3.2 By engaging with our membership, Moments or other activities, you agree to:

  • treat all guests, staff and neighbours with respect;

  • follow any house rules, safety guidance and parking/transport instructions communicated by us;

  • refrain from behaviour that is unlawful, abusive, discriminatory or disruptive.
     

3.3 We reserve the right, in our sole discretion, to refuse or withdraw access to events, memberships or online spaces if these guidelines are not respected.

2.1 Wonderland Foundation exists to create impact through community, creativity and care, including through membership communities, curated gatherings (“Moments”), and partnerships with organisations such as Bridges for Music and DARG. Wonderland Foundation

2.2 Nothing on the Site should be interpreted as financial, legal or professional advice. Our activities are charitable and community-focused in nature.

3. Eligibility & Community Guidelines

4. Memberships, Gatherings & Guest List

4.1 Certain gatherings and experiences are invitation-only and may be limited to:

  • members of the Wonderland Members Club,

  • participants in our Moments @ Wonderland community, and

  • personally invited friends of existing guests or members.
     

4.2 Access to such gatherings is generally managed via a curated guest list. Being subscribed to the newsletter, following social channels or visiting the Site does not automatically guarantee access.

4.3 Where participation contributions are requested for a specific experience (for example, to cover food, production and charitable support), these will be clearly communicated in the invitation or information material for that gathering.

4.4 We may change, reschedule or cancel a gathering if required by weather, safety, legal regulations, capacity limits or other circumstances beyond our control. Where practical, we will communicate changes in advance via email or group communication.

5. Donations & Payments

5.1 The Site may allow you to make voluntary donations or pay participation contributions via integrated payment providers.

5.2 By submitting payment details, you confirm that you are authorised to use the selected payment method and that all information provided is accurate.

5.3 Unless explicitly stated otherwise, donations are non-refundable, as they are used to support our projects and partner organisations.

5.4 For specific events where a participation contribution is requested, any applicable refund or cancellation terms will be communicated in the event information or confirmation email.

6. Wonderland Dollars & Event Currencies

6.1 For certain gatherings we may use “Wonderland Dollars” or similar event currencies as a playful way of engaging with food, beverages, experiences or charitable activities.

6.2 By participating you understand and agree that:

  • Wonderland Dollars have value only within the context of the event for which they are issued;

  • Wonderland Dollars cannot be exchanged back into South African Rand (ZAR) or any other real currency;

  • any Wonderland Dollars spent in designated charity activities (such as casino-style games for good cause) are treated as charitable contributions and are non-refundable.

7. Parking, Transport & Neighbour Consideration

7.1 To protect our neighbours’ privacy and to comply with local considerations, we may enforce strict parking and access rules for certain gatherings.
 

7.2 If we communicate that no parking is allowed near or in front of the property and that guests must use designated shuttle points or transport solutions, you agree to respect these rules.
 

7.3 We reserve the right to deny entry to guests who disregard clearly communicated parking or access instructions, without any obligation to provide a refund.

8. No Own Beverages

8.1 For most gatherings, guests are not permitted to bring their own alcoholic or non-alcoholic beverages unless we explicitly allow it in writing for a specific experience.

8.2 We may confiscate or request removal of any unauthorised beverages and, in serious cases, may ask guests to leave the venue.

9. Intellectual Property

9.1 All content on the Site, including text, graphics, images, logos, photographs, audio-visual material and layouts, is owned by or licensed to Wonderland Foundation and protected by applicable intellectual property laws.

9.2 You may view the Site for personal, non-commercial use. You may not copy, reproduce, distribute, modify or create derivative works from Site content without our prior written consent.

10. Third-Party Links & Partners

10.1 The Site may include links to third-party websites or partner organisations (for example, Bridges for Music and DARG). These are provided for information only. Wonderland Foundation

10.2 We are not responsible for the content, privacy practices or terms of any third-party sites. Your use of those sites is at your own risk.

11. Privacy

11.1 We respect your privacy and handle personal information in accordance with our Privacy Policy, which forms part of these Terms. Wonderland Foundation

11.2 By using the Site or sharing your details with us (for example, to subscribe, donate, join a membership or attend a gathering), you consent to our processing of your information as described in the Privacy Policy.

12. Disclaimers & Limitation of Liability

12.1 While we take reasonable care to ensure that the information on the Site is accurate and up to date, the Site is provided on an “as is” and “as available” basis.

12.2 To the fullest extent permitted by South African law, we do not guarantee that:

  • the Site will always be available, secure or error-free;

  • all information is complete, accurate or suitable for your specific purposes.
     

12.3 Wonderland Foundation, its directors, volunteers and representatives will not be liable for any indirect, incidental, consequential or special loss or damage arising from or in connection with your use of the Site, donations, or attendance at our gatherings, except where caused by our gross negligence or intentional misconduct.

12.4 Nothing in these Terms seeks to exclude or limit liability where such exclusion or limitation would be unlawful, including any liability for death or personal injury caused by our gross negligence.

13. Changes to These Terms

13.1 We may update or amend these Terms from time to time.

13.2 The updated version will be posted on the Site with an updated “last revised” date and will apply from the date of publication.

13.3 Your continued use of the Site after changes are made constitutes your acceptance of the revised Terms.

14. Governing Law & Dispute Resolution

14.1 These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of the Republic of South Africa.

14.2 Where possible, any dispute between you and Wonderland Foundation should first be addressed through good-faith discussions. If we cannot resolve the issue informally, the dispute may be referred to mediation or, failing that, to the competent courts of South Africa.
